There are two types of penalties if Form 1120 is filed late or if there is a late payment
of taxes.

  • Late Filing Penalty: If a corporation fails to file its 1120 return by the due date (including extensions), it will face a penalty of 5% of the unpaid tax for each month or part of a month the return is late. The penalty can accumulate up to a maximum of 25% of the unpaid tax.

    If the return is over 60 days late, the minimum penalty is either the tax due or $510.

  • Late Payment Penalty: If the corporation does not pay the tax due by the original deadline, a penalty of 0.5% per month on the unpaid tax will be applied. This penalty can also accumulate up to a maximum of 25% of the unpaid tax.
